Welcome to Holiday Build Countdown! These Terms of Service ("Terms") govern your access to and use of the website https://blockadventcalendar.com (the "Site") and the purchase of products offered by Holiday Build Countdown ("we," "our," or "us"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

1. Acceptance of Terms

By accessing or using any part of the Site, you agree to be bound by these Terms. These Terms apply to all users of the Site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

2. Eligibility

To make a purchase through the Site, you must be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater. By using the Site, you represent and warrant that you meet these age requirements. Our products are intended for ages 6+ as indicated on the product listing, but purchases must be made by an adult.

3. Account Responsibilities

If you create an account on the Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. Product Descriptions and Pricing Accuracy

We strive to ensure that all product descriptions, images, and pricing information on the Site are accurate and up-to-date. However, we do not warrant that product descriptions or other content of this Site is accurate, complete, reliable, current, or error-free. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time.

The "Christmas Advent Building Blocks Calendar" is a twelve-day Christmas countdown building-block gift box, containing 605 pieces, and is recommended for ages 6+.

5. Order Acceptance and Cancellation Rights

Your placement of an order does not necessarily assure that we will accept your order. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

6. Payment Terms

All prices are listed in USD. Payment for all products must be made in full at the time of order placement. We accept various payment methods as indicated on the Site (e.g., major credit cards, PayPal). You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

7. Intellectual Property

All content on the Site, including text, graphics, logos, images, product designs, and software, is the property of Holiday Build Countdown or its content suppliers and protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, duplicate, copy, sell, resell or exploit any portion of the Site, use of the Site, or access to the Site or any contact on the website through which the service is provided, without express written permission by us.

8. User Conduct

You agree not to use the Site for any unlawful purpose or in any way that might harm, abuse, or otherwise interfere with the Site or our business. You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law.

9. Limitation of Liability and Disclaimer of Warranties

The Site and all products and services delivered to you through the Site are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Holiday Build Countdown, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

10. Indemnification

You agree to indemnify, defend and hold harmless Holiday Build Countdown and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

11. Governing Law and Dispute Resolution

These Terms of Service and any separate agreements whereby we provide you products shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Toronto, Ontario, Canada.

12. Severability Clause

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
